BUSINESS TERMS AND CONDITIONS

The general terms and conditions of the time4off.com online are composed in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1). We advise to read them carefully before using this online store. By using the website, you are consenting to the mentioned terms. In case, you do not agree to the terms, we kindly ask to leave the website.

Time4off.com online store reserves the right to change the terms of the website at any time without prior notice. All changes are binding to the customers. That is why we recommend that you regularly review the Business Terms and Conditions. Time4off.com online store (hereinafter: “store”) is managed by the company:

that is also an e-commerce service provider (hereinafter: seller or time4off.com).

The general terms and conditions define the operation of the time4off.com online store, the rights and obligations of the user and the store, and regulate the business relationship between time4off.com and the customer. The buyer is bound by the general terms and conditions in force at the time of purchase (online order submission). When placing an order, the buyer is reminded of the general business terms and conditions. By making a purchase, the buyer confirms he is familiar with them.

ORDERING

Potential buyers that wish to make a purchase need to be registered or signed in as a guest. By registering, the visitor becomes a user and acquires the right to purchase.

If a certain product is not in stock, we will notify you about changing the order.

Company Na OFF, Marko Bauman s.p. reserves the right to extend delivery times if the product is out of stock or due to logistical problems.

PRICES

All prices in the online store are in Euro (€) and include VAT. Prices do not include shipping costs of 5,50 €. The shipping cost is displayed when calculating the value of the order before electronic order confirmation.

Prices are for informational purposes only and are subject to change without prior notice. Prices are valid at the time when order is placed and do not have predefined validity. In case the price of the product changes during the processing of the order, the provider will allow the buyer to withdraw from the purchase. At the same time, the provider will try to find a solution that will be of mutual satisfaction.

METHOD OF PAYMENT

The following payment methods are available at time4off.com online store:

● Bank transfer (pro forma invoice): after your order is confirmed, you will receive the pro forma invoice and the order is then shipped after inflow is visible on our bank account. Payment must be made no later than 3 days from the date of the order, otherwise the order will be closed as unsuccessful. The amount of the pro forma invoice should be transferred to the bank account: SI56 2900 0005 2885 324, UNICREDIT BANK SLOVENIA PLC, Na OFF, Marko Bauman s.p., Žabjak 13E, 2250 Ptuj. Enter the order number in the title.

● PayPal: if you have a Paypal account you can easily pay the purchase amount with it.

DELIVERY METHOD

Delivery of parcels is carried out through Post of Slovenia, where all shipments are properly tracked and secured. Post of Slovenia will notify you via email of the status of your package. For faster delivery or delivery to countries abroad, you should make an arrangement via phone or e-mail.

DELIVERY PERIOD

The delivery period varies depending on the availability of the product. If the goods ordered are currently not in stock, we will notify you by e-mail or telephone about the intended delivery time.

When the goods ordered have different delivery periods, the delivery will be made within the time limit applicable to the product with the longest delivery period.

DISCOUNT CODE

The discount code brings various benefits when shopping through time4off.com and is always limited in time.

Using the discount code:

Select the items you want to buy and add them to the cart. When you have finished adding items to your cart, continue by clicking the checkout button.

Choose a shipping method, provide a shipping address, and choose a payment method. In the same step, enter the discount code in the discount code field and confirm the entry by clicking the Redeem button. You cannot use multiple discount codes at the same time. Then click the Redeem button.

Only one discount code can be redeemed for one purchase.

When you enter the discount code, the value of the discount code is automatically deducted from the price of your order in the last step.

The discount code is a one-time code, meaning you can only use it once.

WITHDRAWING FROM ORDERED GOODS

The consumer has the right to inform the seller within 14 days of receiving the goods that he is withdrawing from the contract without having to state a reason for his decision. The deadline begins one day after the goods are delivered.

The consumer will notify the seller about his withdrawal from the contract via e-mail: marko@naoff.si.

In case of withdrawing from the contract, the consumer returns the received item to the address of the seller’s headquarters: Na OFF, Marko Bauman s.p., Žabjak 13E, 2250 PTUJ.

The return of the received items to the company within the withdrawal date is NOT considered as a notice of withdrawal from the contract.

The consumer is responsible for any reduction in the value of the goods if the value loss is the result of conduct which is not necessary to determine the nature, characteristics, and functioning of the goods. The only cost charged to the consumer in connection with the withdrawal from the contract is the cost of returning the items (which is charged according to the price list of the delivery service.)

The item must be returned to the seller within 30 days after the notice of withdrawal from the contract (purchase). Refunds will be processed as soon as possible and no later than 14 days from the date of receiving the notice of withdrawal or an unequivocal statement.

In accordance with the third paragraph of article 43 of ZVPot, a company shall refund received payments to the consumer with the same payment method consumer used, unless the consumer has explicitly requested the use of another payment method and the consumer does not bear any costs as a result. When withdrawing from a contract where a discount code was used, these funds are considered as a discount and will not be returned to the consumer. Only the amount paid by the consumer is refunded.

In exceptional cases, when the items are not returned in accordance with the ZVPot, consumers are offered purchase of the item with appropriate compensation, which is determined by the record upon return. Reduced value purchases are taken into account when the consumer confirms by e-mail.

The consumer can only take advantage of the mentioned payment when ordering another item of equal or higher value.

EXCHANGING PRODUCTS

The consumer has the right to inform the company within 14 days of receiving the goods that he wants to change the product without having to give a reason for his decision. The message is considered to be timely if the delivery is dispatched on time.

The goods must be returned to the company within 30 days of the notice of withdrawal. The buyer covers the shipping cost when sending a package from his address to the seller’s address. We replace the product and resend it to the buyer, at the expense of the seller. All parts of the package must be included in the package we receive. In case one or more parts are missing, we cannot offer a replacement.

When shipping, we recommend that you secure the product or pack it in a cardboard box. You can send the product back in the cardboard box in which you received the product. The invoice needs to be included in the package as well. In the event of a return of the product without the invoice, we cannot replace the item.

If the buyer claims the right to refund of the product with a material defect (factory damaged product), the seller is obliged to return the full value of the purchase price of the product. The buyer has the right to claim his rights for a material defect within two months of the defect being discovered.

MATERIAL DEFECT

When:

• the item does not have the characteristics necessary for its normal use or transport
• the item does not have the characteristics necessary for the specific use for which the buyer is buying it, which however was known or should be known to the seller
• the item does not have the characteristics and attributes that were explicitly or impliedly agreed upon or prescribed
• the seller has delivered an item that does not match the sample or model unless the sample or model was shown for notice only.

How is the suitability of the item checked? It is compared with another, flawless item of the same type, and manufacturer’s specifications or specifications on the item itself. How is material defect claimed?

The buyer must notify us of any material defect, along with a precise description of it, within the statutory time limit, and at the same time allow us to inspect the item. The right to claim a material defect on the item is governed by the provisions of the consumer protection act.

RESOLVING COMPLAINTS

Complaints regarding offers and purchases on the website are resolved by our complaint department, which is available to the buyer during working hours from Monday to Friday between 8am and 4pm. The contracting parties agree to settle all disputes by mutual agreement. In the event that the dispute cannot be reached, the court of law, depending on the seller’s headquarters, has jurisdiction.

The buyer is obliged to take over the item which he has delivered to the seller for warranty or other consideration after the end of the process.

The buyer picks up the item at the pickup point where he handed it over to the seller. In cases where the product was sent by mail, it will be returned to the proper address. The seller sends a return notification to the buyer and asks him to pick up the item.

EXCLUSION OF LIABILITY

The merchant is doing its best to ensure that the website includes accurate and up-to-date information about the product, prices and stock. Item pictures are an actual item display, but the color of the item may slightly differ from the picture displayed on the consumer screen (different color settings of the screens).

The merchant strives for the highest possible degree of timeliness and accuracy of the published information on the site. However, the reduced rate of operation of the technology service used, input, transmission or any other processing of data may result in errors that are displayed on the website. In the event that the visitor of the website thinks that this information is incorrectly displayed, he may inform the merchant via his contact addresses. The merchant is not responsible for the occasional inaccuracy of the website, possible incorrectness of the information and also for any damage caused by the use of inaccurate or incomplete information and the inability to access and use the information on these websites.

Special prices and special discounts are valid until the stock is depleted.

Provider reserves the right to disable the website or to disable access to it due to technical or other problems and maintenance, which also means disabling or obstructing the use of the online store. The provider is not responsible for a compensation of any damage or costs that the user may have due to the termination, inactivity or obstruction of the use of the website.

The provider does not guarantee the accuracy, completeness and correctness of the content published on the website, nor does it accept responsibility for the damage that the user might suffer due to the reliance on the published content. The provider is not responsible for any damage that may occur to the user’s hardware, software or other equipment due to the use of the website. The user himself must ensure proper safety of equipment (antivirus, etc.) before accessing and using the website. Each buyer agrees to the general terms of business when he makes a purchase and provides personal information and permits further contact with the purpose to inform about news, promotions, etc. In case the buyer wishes not to be contacted, he must notify the company via email to marko@naoff.si.

PROTECTION OF PERSONAL DATA

(Personal Data Protection Act ZVOP-1 and EU Regulation 2016/679)

In accordance with the Personal Data Protection Act ZVOP-1 and Regulation (EU) 2016/679 after 25.5.2018, the company Na OFF, Marko Bauman, s.p., Žabjak 13E, 2250 Ptuj, and its related online store time4off.com needs to obtain consent from potential customers and visitors for the processing of personal data.

All information will be handled confidentially and will only be used for internal records and for the purpose for which it was provided. Your information will be carefully protected against loss, misuse, unauthorized access, disclosure, alteration or destruction. When signing up for newsletters and receiving a discount coupon, we will collect and process the following personal information: First and last name, Email address.

Company Na OFF, Marko Bauman s.p., Žabjak 13E, 2250 Ptuj – Online store time4off.com, as the manager of personal data, may use and process the information obtained in accordance with the provisions of the personal data protection regulations for all the purposes and communication channels listed below:

– managing the database and sending offers
– performing marketing activities – advertising
– analyzing and studying shopping habits
– monitoring and recording delivery of emails (whether the owner received them)
– monitoring and recording what content the email address owner has opened or read (monitoring clicks of web links contained in emails)
– providing additional offers
– conducting prize games and participating in promotional events, which includes raffles and the publication of information on the selected winners and the collection of personal data at promotional events.

When placing an order at OFF.si online store, we will collect and process the following personal information: Name, Address, Postcode, City, Phone, Email.

We will carefully store and process the collected personal data until a visitor or time4off.com buyer, demands deletion or does not log out. We will not share the personal data with anyone, nor will we send it to anyone. Collected data will be intended exclusively for the above purposes.

OTHER PROVISIONS

All rights under the Consumer Protection Act belong to the buyer. All the terms and conditions stated here are binding on the buyer and the company Na OFF, Marko Bauman s.p. All possible disputes will be settled by mutual agreement between the contracting parties. In the event that an agreement cannot be reached, the dispute will be settled by the competent court in PTUJ.

The concluded contracts are stored in electronic form on the company server belonging to Na OFF, Marko Bauman, s.p. It is possible to view them only when the buyer makes a prior announcement.

COMPLAINTS AND DISPUTES

Company Na OFF, Marko Bauman s.p. respects the valid consumer protection legislation and strives to fulfill its duty to provide an effective complaints system.

The complaint should be submitted via email to marko@time4off.com. The procedure for handling the complaint is confidential. Na OFF, Marko Bauman s.p. is aware that an essential feature of consumer disputes is the disproportion between the economic value of the claim and the time and the costs that occur because of resolving the dispute, which happens to be a major obstacle that the consumer does not bring a dispute to court.

Therefore, Na OFF, Marko Bauman, s.p. is striving to resolve any disputes by mutual agreement. In the event that an agreement cannot be reached, the dispute will be settled by the competent court in PTUJ.

Out-of-court settlement of consumer disputes:
In accordance with the legal norms Na OFF, Marko Bauman s.p. does not recognize any out-of-court dispute resolution contractor as competent to settle a consumer dispute that could be initiated by a consumer in accordance with the Out-of-Court Consumer Dispute Resolution Act. time4off.com, which, as a provider of goods and services, facilitates online commerce in the Republic of Slovenia, is publishing an electronic link to its Consumer Dispute Resolution Platform (SRPS) on its website. The platform is available to the consumers here. That stated arrangement stems from the Out-of-Court Consumer Dispute Resolution Act, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on the online settlement of consumer disputes, and amended Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.
